Terms and Conditions

Short-term motor vehicle rental agreement between Rentauto Dominicana, S.A. (hereinafter THE LESSOR) and the renter (hereinafter THE LESSEE). These terms govern every rental made through Nelly Rent a Car.

1. Vehicle delivery and return condition

THE LESSOR delivers the vehicle described in this Agreement to THE LESSEE, who accepts it, together with the price and conditions set forth in clauses 2, 3, 4, 5, 7 and 8. THE LESSEE declares that the vehicle has been received in perfect working condition with all its documents (copy of vehicle registration and insurance sticker), tires, tools, accessories and equipment, and undertakes to return it in the same condition at THE LESSOR's premises, with the same amount of fuel with which it was received, or to pay the corresponding amount for replacement.

If THE LESSEE decides to return the vehicle at a station other than the one where it was received, he/she is obliged to pay THE LESSOR the charges for this service, or any other expenses incurred for the transfer of the vehicle to the station where it was received.

2. Authorized drivers and permitted use

The rented vehicle shall be driven only by THE LESSEE, and if during the term of the rental the vehicle suffers any damage or total loss while being driven by a person not authorized by THE LESSOR, THE LESSEE acknowledges and agrees to pay for the entirety of the damages suffered by the vehicle, even if he/she has purchased all the coverage products offered by THE LESSOR.

THE LESSEE may designate additional drivers, who must provide THE LESSOR with their documents and valid driver's licenses, provided that THE LESSEE covers the costs of this service, which are indicated on the reverse side of this agreement.

THE LESSEE acknowledges that the vehicle may not be used to: a) if the vehicle is intended for passenger transport, it may not be used for other purposes; likewise, if it is designated for cargo transport, it may only be used for that purpose; b) to push or tow another vehicle; c) for sports, speed or racing tests; d) under the influence of alcohol or narcotics; e) to be driven by minors; f) to cross the border with Haiti, unless expressly authorized by THE LESSOR; g) to cross rivers.

3. Rental charges and financial obligations

THE LESSEE expressly agrees to pay THE LESSOR, at the end of the contract: a) The rental price until the vehicle is delivered, plus the taxes established by Dominican legislation for this type of service and other charges generated by the rental of the vehicle, such as prepaid fuel, delivery of the unit at a station other than the one rented, additional coverages, additional drivers, use of extra hours and days, which will be informed to THE LESSOR in advance; b) For any damage suffered by the vehicle during the term of this contract.

If, due to accidents, theft or general casualties, the vehicle must be repaired, or if, due to traffic violations or the current legal regime, it is detained by the authorities, THE LESSEE is obliged to pay THE LESSOR the agreed daily rental rate for the time that the repair or the legal procedures necessary for the recovery of the vehicle last; this charge would be equivalent to the loss of profits.

If THE LESSOR decides to return the vehicle before the date agreed on the front of this contract, a penalty will be applied, by way of penalty, equal to the value quoted in the reservation for the rental time initially requested.

All fines, judicial and extrajudicial expenses, derived from traffic infractions or any other kind directed against the vehicle under the terms of this contract, during its duration, shall be borne by THE LESSEE.

4. Late return

If THE LESSEE does not return the vehicle within seventy-two (72) hours after the end of the rental period, he/she shall be considered an unfaithful depositary and the corresponding criminal action may be exercised.

5. Coverage and financial responsibility

THE LESSOR offers THE LESSEE, for an additional daily value specified in this contract, a financial responsibility coverage for damages and losses to the rented vehicle, which will apply as long as the terms of this Contract and the current legal provisions in the country have been complied with.

THE LESSEE acknowledges that he/she may opt for the coverage specified in this clause, unless he/she presents an international credit card that has NOT been issued in the same country where the rental is being made, in which case the coverage for damages caused will be claimed through the international credit card insurance.

THE LESSEE acknowledges that if he/she declines this protection, he/she assumes full financial responsibility for the value of the rented vehicle and any other that may arise from the event that caused the damage or loss of the vehicle.

If during the rental physical damages occur, caused by movable objects or inanimate things, as a result of a collision, provided that these damages are not caused by negligence, recklessness, malicious damage, vandalism, riot, political activities, strikes, driving on rocky or unpaved terrain, landslides, speeding or the terms and conditions established in this contract are not violated, in which case THE LESSEE must cover the entirety of the damages caused both to the vehicle and to third parties or properties.

6. Accidents

In case of an accident, THE LESSEE undertakes to: a) Obtain a Police Report or from any other competent body, once the accident has occurred and deliver it within seventy-two (72) hours of the occurrence to THE LESSOR, a sine qua non condition for the coverage to apply; b) obtain names and addresses of the persons involved in the accident, as well as data that allows identification of the other vehicles involved; c) not abandon the vehicle without taking appropriate measures to protect and safeguard it; d) complete and deliver an accident report, and inform THE LESSOR in detail of what happened.

If, at the time of receiving the vehicle, THE LESSOR determines that the vehicle was repaired at THE LESSEE's own expense, without prior authorization from THE LESSOR, THE LESSOR may apply the charges to be incurred for the repair of the vehicle according to the standards required by the manufacturer of the rented vehicle.

7. Collection tracking

THE LESSEE authorizes THE LESSOR to use PURCO Fleet Services as a collection tracking tool in cases where it is warranted.

8. Personal belongings

THE LESSOR is not responsible for the personal belongings of THE LESSEE left inside the vehicle or in its offices, nor for any damage or deterioration they may suffer.

9. Mechanical or electrical breakdowns

If any mechanical or electrical breakdown occurs to the vehicle, THE LESSEE must contact THE LESSOR within twenty-four (24) hours from the time he/she becomes aware of the breakdown, in order to receive instructions from THE LESSOR, either to replace the vehicle at the place of the breakdown (either by telephone call to the station where the vehicle was rented), or to send a technician, or to authorize taking the vehicle to a workshop.

If THE LESSEE does not immediately make such communication or does not comply with the instructions received, THE LESSOR shall not be obliged to reimburse the expense incurred due to the breakdown and shall have the right to require it from THE LESSEE if THE LESSOR paid it directly.

10. Security deposit

THE LESSEE deposits as an advance guarantee, in the hands of THE LESSOR, the amount indicated on the reverse of this contract, for the fulfillment of the obligations contracted therein, without considering the violations that may be committed of the contract clauses. THE LESSEE authorizes THE LESSOR to dispose totally or partially of the deposit, as it deems convenient, in order to cover any of the services stipulated in clauses 2, 3, 4, 5, 7 and 8 of this Contract, prior notification to THE LESSEE by e-mail.

11. Applicable law and jurisdiction

Any controversy related to the subscription, execution or termination of this contract shall be under the jurisdiction of the Courts of the Dominican Republic. Likewise, THE PARTIES declare that common law shall govern, on a supplementary basis, their relations for everything not provided for in this contract.
